By downloading or using Notch ("the App"), you agree to these Terms of Use. If you don't agree, don't use the App.

1. What Notch Is

Notch is an AI-powered fitness coaching application that generates personalized workout programs and provides real-time coaching guidance. The App is designed to assist with your fitness goals but is not a substitute for professional medical advice, diagnosis, or treatment.

2. Medical Disclaimer

Notch is not a medical device and does not provide medical advice. The workout programs, coaching suggestions, and fitness guidance provided by Notch are generated by artificial intelligence and should not be treated as professional medical or fitness advice.

You should consult a qualified healthcare provider before starting any new exercise program, especially if you have pre-existing medical conditions, injuries, or health concerns. You exercise at your own risk. Notch and its creators are not liable for any injuries, health issues, or damages that may result from following AI-generated workout recommendations.

3. Your Account

Notch creates an anonymous account for you automatically. You are responsible for maintaining access to your device, as your account is tied to your device's authentication. If you delete the app or lose access to your device, your account may not be recoverable.

4. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Attempt to access other users' data or bypass security measures
• Use the App for any unlawful purpose
• Interfere with or disrupt the App's services or servers
• Use automated scripts or bots to interact with the App

5. Subscriptions & Billing

Notch offers a premium subscription billed through Apple's App Store. By subscribing, you agree to the following:

• Payment is charged to your Apple ID account at confirmation of purchase
• Your subscription automatically renews unless canceled at least 24 hours before the end of the current billing period
• You can manage and cancel your subscription in your device's Settings > Apple ID > Subscriptions
• Refunds are handled by Apple in accordance with their refund policy

Free trial eligibility, if offered, is determined by Apple and is available once per Apple ID.

6. AI-Generated Content

Workout programs, exercise recommendations, and coaching responses are generated by artificial intelligence. While we work to ensure quality and safety, AI-generated content may occasionally contain errors or inappropriate suggestions. Always use your own judgment and stop any exercise that causes pain or discomfort.

7. Intellectual Property

The Notch app, including its design, code, AI models, and content, is owned by Notch and protected by intellectual property laws. Your subscription grants you a personal, non-transferable, non-exclusive license to use the App.

8. Limitation of Liability

To the maximum extent permitted by law, Notch and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes but is not limited to physical injury, loss of data, or loss of profits. Our total liability for any claim arising from the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to Notch at any time for violation of these terms or for any other reason at our discretion. You may stop using Notch at any time by deleting the App and canceling any active subscription.

10. Changes to These Terms

We may update these terms from time to time. If we make significant changes, we'll update the "Last updated" date at the top of this page. Continued use of Notch after changes constitutes acceptance of the updated terms.
